Legal Framework

The Law on Public Procurement (Official Gazette of the Republic of Serbia, No. 91/19 and 92/23), in Article 185, stipulates that the contracting authority is obliged to provide persons performing public procurement tasks with training in performing public procurement tasks and taking the exam for public procurement officers, as well as continuous training. The Public Procurement Office prescribes the procedure and conditions for obtaining a certificate for public procurement officers and maintains a register of public procurement officers.

The Regulation on the Procedure and Conditions for Obtaining a Certificate for Public Procurement Officers and Maintaining the Register of Public Procurement Officers (Official Gazette of the Republic of Serbia, No. 93/20, 21/21, 115/23 and 6/24) prescribes the procedure and conditions for obtaining a certificate for public procurement officers, as well as the use of legal sources from Article 2, paragraph 1 of this Regulation for the purposes of professional training and preparation for taking the professional examination for officers. Also, the procedure for taking the exam for a public procurement officer has been regulated, and the status of a candidate for taking the exam is held by a person with higher education in basic academic studies in the amount of at least 240 ECTS credits or master’s academic studies, specialist academic studies, specialist vocational studies, or basic studies lasting at least four years or specialist studies at a faculty, who has submitted an application for taking the exam or for whom the application was submitted by the contracting authority or other legal entity.

Application for Taking the Exam

The exam for public procurement officers is usually organized for at least 15 registered candidates. The dates and venue of the exam are published by the Public Procurement Office on its website.

The application for taking the exam is submitted to the Public Procurement Office on the application form.

APPLICATION FOR TAKING THE EXAM FOR ACQUIRING A CERTIFICATE FOR PUBLIC PROCUREMENT OFFICER

Along with the application for taking the exam, the candidate submits proof of paid exam costs, which amount to 3,000.00 RSD.

The exam costs (3,000 RSD) include the costs of taking both the WRITTEN and PRACTICAL parts of the exam.

If a candidate does not pass the written part of the exam, he/she is considered to have failed the exam and may re-apply for the exam, in which case he/she shall pay the costs in the amount of 3,000 RSD.

If a candidate successfully completes the written part of the exam, but does not pass the practical part of the exam, he/she has the option of re-applying for the PRACTICAL PART OF THE EXAM within 6 months from the date of notification of the exam results, in which case he/she shall pay the costs in the amount of 2,000 RSD.

Application for taking the exam is submitted to the email address: sluzbenik@ujn.gov.rs. Along with the completed application form, it is necessary to submit evidence in the manner described in more detail in the application form.

The Public Procurement Office approves the exam by decision. The candidate is notified of the approval of taking the exam at the email address specified in the application no later than 15 days before the exam date. The decision on approval of taking the exam contains, in particular, the candidate’s name and surname, information on the date, time and place of the exam.

The exam consists of two parts: written and practical.

At the request of the candidate, the Public Procurement Office may postpone the exam if the candidate is prevented from taking the exam due to illness or other justified reasons. The candidate is obliged to make the reasons for requesting the postponement of the exam plausible.

The written part of the exam is taken by testing for 180 minutes without interruptions or breaks. During the exam, the use of laws and bylaws is permitted, unless they are in the form of publications containing explanations of individual articles of those regulations.

The test for each exam is determined separately by the test committee. The test has a total of 55 exam questions, of which 15 questions carry one point each, 35 questions carry two points each and 5 questions carry three points each, which makes a total of 100 points. The examination committee evaluates the candidate’s success, and a candidate who scores at least 75 points on the exam has passed the written part of the exam and is eligible to take the practical part of the exam. The examination committee has at least three members, consisting of representatives of the Public Procurement Office.

The Public Procurement Office shall, within 15 days from the date of the exam, deliver to the candidate who has passed the written part of the exam a notification of the results of the written part of the exam and an invitation to take the practical part of the exam.

The practical part of the exam shall be taken no earlier than 7 days and no later than 45 days from the date of the written part of the exam, by testing the work on the Public Procurement Portal.

The test for the practical part of the exam lasts 120 minutes without interruptions and breaks and has a total of three tasks. The commission evaluates the candidate’s success in the practical part of the exam with a grade of “passed” or “failed”, and a candidate who successfully completes all three tasks has passed the practical part of the exam.

A candidate who has taken the exam may inspect his or her test by submitting a request for inspection of the test to the Public Procurement Office. The Public Procurement Office will provide the candidate with inspection of the test within three days of receiving the request.

The candidate has the right to object to the exam results within seven days of receiving the notification, which he or she may submit to the examination commission through the Public Procurement Office. The examination commission shall decide on the candidate’s objection within seven days of receiving the objection.

In the event that the candidate fails the practical part of the exam, applications for retaking the practical part of the exam may be submitted to the Public Procurement Office no later than six months from the date of delivery of the notification of the exam results.

If the candidate does not submit the application within the specified deadline or if he/she does not pass the practical part of the exam according to the applications submitted within that deadline, he/she will be considered to have failed the written part of the exam.

The application for re-taking the practical part of the exam shall be submitted to the Public Procurement Office on the application form for re-taking the practical part of the exam.

APPLICATION FOR RE-TAKING THE PRACTICAL PART OF THE EXAM FOR ACQUIRING A CERTIFICATE FOR A PUBLIC PROCUREMENT OFFICIAL

Along with the application for re-taking the practical part of the exam, the candidate shall submit proof of paid expenses amounting to 2,000.00 RSD.

Acquisition of a Certificate

The requirement for obtaining a certificate for a public procurement officer is passing the exam.

The following legal sources are used to prepare for the exam for obtaining the certificate: 1) Law on Public Procurement (“Official Gazette of the Republic of Serbia”, No. 91/19 and 92/23) and by-laws adopted on the basis of that law; 2) Law on General Administrative Procedure (“Official Gazette of the Republic of Serbia”, No. 18/16 and 95/18 – authentic interpretation and 2/2023 – decision of the Constitutional Court) and 3) Law on Obligatory Relations (“Official Gazette of the SFRY”, No. 29/78, 39/85, 45/89 – Constitutional Court, 57/89, “Official Gazette of the FRY”, No. 31/93, 44/99 – other regulations and “Official Gazette of the Republic of Serbia”, No. 18/20), which are listed in Article 2 of the Rules on the Procedure and Conditions for Obtaining a Certificate for Public Procurement Officers and Maintaining the Register of Public Procurement Officers.

During the exam, the use of laws and by-laws is permitted, unless they are in the form of publications containing explanations of individual articles of those regulations.

The exam consists of two parts: written and practical.

The written part of the exam is passed by a candidate who has received at least 75 points out of a possible 100.

The practical part of the exam is passed by a candidate who has successfully completed all three tasks.

A candidate who has given up on the testing that has begun, who has received less than 75 points in the written part of the exam, as well as a candidate who has not achieved the result “passed” in the practical part of the exam is considered to have failed the exam.

A candidate who has passed the practical part of the exam is notified of the results of the practical part of the exam and a certificate of passing the exam within 15 days from the date of passing the practical part of the exam. The certificate for a public procurement officer is acquired on the date of finality of the certificate of passing the exam, and is delivered to the officer within 90 days from the date of passing the exam.
